One s ch ser tweeted this claim with hashtag #transh man and an image that reads, “BRE KING – In the US, the S preme Co rt has r led that vaccinated people worldwide are prod cts, patented goods, according to US law, no longer h man.”

The above claim with the caption ‘US S preme Co rt has r led that vaccinated people are prod cts’ has been widely shared on Twitter and Facebook in the past few weeks.

Fact Check / Verification
The online posts link the vaccine technology to a 2 13 US S preme Co rt case involving the ssociation for Molec lar Pathology and Myriad Genetics.
s per the r ling, Myriad “obtained several patents after discovering the precise location and seq ence of the BRC 1 and BRC 2 genes, m tations of which can dramatically increase the risk of breast and ovarian cancer.”
Ir f rther stated, “ nat rally occ rring DN segment is a prod ct of nat re and not patent eligible merely beca se it has been isolated, b t cDN is patent eligible beca se it is not nat rally occ rring.”
Contrary to the claim in the online posts, the co rt did not find that the h man genome co ld be patented if it was modified.
Note that the Co rt’s decision does not even incl de the words “vaccine” or “vaccines” anywhere.
mRN vaccines are a new type of vaccine that “teach o r cells how to make a protein—or even j st a piece of a protein—that triggers an imm ne response inside o r bodies,” according to Centres for Disease Control and Prevention.
na Santos R tschman, a vaccine law expert, told FP that the Co rt case referred to in the online posts “is not related to the q estion of determining who/what is h man and what is not. There’s no relationship between this case and any claim related to the administration of any type of vaccine, incl ding mRN vaccines.”
Lara Cartwright-Smith, ssociate Professor of Health Policy, George Washington University told P that “receiving an mRN vaccine does not and cannot alter one’s DN , so the basis for the claim is wrong.”
